Conveyancing Explained

Conveyancing is simply the process of transferring legal ownership from the Seller to the Buyer. Conveyancing starts when an offer has been accepted on the Sellers property. It ends when completion takes place and the Buyer becomes the new legal owner of the Sellers property. It is important that you understand the process which is why we recommend that you ask any conveyancing questions that you may have.

Legally Binding

Once a Buyer has made an offer on a Sellers property and it has been accepted by the Seller then the offer becomes legally binding on exchange of contracts. The Buyer would before exchange use an experienced Lawyer to manage the property legals. A survey on the property should be carried out so that any required property repairs are highlighted. The Surveyor will advise what is required to bring the property up to the RICS standard.

Negotiating further with the Seller

When an offer is made on a property it is made 'Subject to Survey' . The offer can be re-negotiated after a Survey has taken place. The buyer uses the Survey results to discuss a possible reduction to the initial offer. Alternatively the Buyer may decide to ask the Seller to carry out repairs. Once repairs have taken place it is often a requirement by the Mortgage Lender to re inspect the works. This of course is best practice as it gives the Buyer peace of mind that the repairs have been carried out properly that meet the RICS standard.
