Questions to ask

If you are buying a New Build or buying a property where the seller is not in a chain then you can ask the following question.

How long does conveyancing take with no chain? Your property conveyance should be fast. It is up to you to get your Conveyancer instructed promptly. You can then discuss a realistic process timescale and get moving. Aim for 5 -8 weeks from your Solicitor receiving your signed paperwork so that they can start.

How long does conveyancing take on average? The majority of Homebuyers are involved in a chain and with all those complex decisions and results from Surveys, Mortgage offers comes delays. In our experience you should ask your Solicitor to determine for you an expected completion date. They will do this by understanding who is in the chain and what the key milestones are within the chain.

3 to 4 months is the average Conveyance although you can speed this up by understanding what your Seller needs. It could be that you could offer a fast completion if your Seller is prepared to move out and move in to rented accommodation. It is important that you set the scene early on with your conveyance. How long do searches take when buying a house? If you were at risk because of say a mining issue then the adviser tool would flag this up to them and they would pass this recommendation on to you.

The searches are fast if your Mortgage Lender allows the Conveyancer to use non local authority searches. in our quotes we assume that is the case as we know that you want your searches returned promptly so that you have no delays. A week is plenty of time to get the searches back. Some take just 24 hours. If you are under time constraints then flag this up with your Conveyancer. The Local Authority search timescale can be lengthy depending on which location you are buying in.

New build developments often need a 28 day exchange of contracts after your offer has been accepted. Having your Conveyancer in place is key to enjoying a swift exchange of contracts and on time completion. 

How long does it take from draft contract to exchange of contracts? This can take some time and relies on the Buyers Solicitors receiving the Sale draft contract promptly. On receipt the Buyers Solicitor will review the draft and discuss with the Buyer and then negotiate terms with the Sellers Solicitor. We would suggest that to draw up contracts for a house, property that a 6 week timescale should be scheduled to then move towards an agreeable exchange of contracts date.

The Lender will ask the Buyer's Solicitor if the Buyer has House Insurance in place. The Buyer's Solicitor cannot exchange unless they have seen the Insurance policy.

Do I need a Lawyer to remortgage with the same lender? You will need a Conveyancer to remortgage with the same Lender. Some Lenders provide this service free of charge. The legal checks still need to be carried out. Your Lender will advise. If costs are involved then ask your Lender if you can use an alternative Conveyancer that is on their approved lender panel.
